1. Agreement to Terms

By accessing or using eventtally "we," "our," or "us," you agree to be bound by these Terms of Service. These Terms constitute a legally binding agreement between you and eventtally regarding your use of our website and services. If you disagree with any part of these terms, you may not access our services.

2. Nature of Our Marketplace

eventtally is an online marketplace that connects users ("Clients") with event venues, vendors, and vendors ("Service Providers"). It is important to understand that:

  • We are a Facilitator: We provide the platform for connection but are not a party to any contract, agreement, or transaction between Clients and Service Providers.
  • No Endorsement: While we may verify certain credentials, we do not endorse, guarantee, or assume responsibility for the quality, safety, or legality of services provided by Service Providers.
  • Direct Contracting: Any booking or contract for services is strictly between the Client and the Service Provider. eventtally is not responsible for the fulfillment of these contracts.

Payments, refunds, and disputes

  • Platform fee and VAT: eventtally charges a 5% platform fee on each transaction. Nigerian Value-Added Tax of 7.5% is applied to the platform fee component and shown on every receipt.
  • Pricing transparency: The buyer sees the full price breakdown (subtotal, VAT, total) at checkout before confirming payment. The fee is included in the listed price, not added on top.
  • Cancellation policy: Every order is stamped with the cancellation policy in effect at the time of purchase. The default policy is a full refund up to 7 days before the event date, with no refund within 7 days. Vendors may publish a more permissive policy on individual listings.
  • Refunds: Refund requests are initiated by the buyer from their order page and approved or rejected by the vendor. Where the buyer and vendor cannot agree, either party may escalate to eventtally's support team for review.
  • Currency and processor: Transactions in Nigerian Naira (NGN) and US Dollar (USD) are supported. Payments are processed by Paystack, a CBN-licensed payment service provider, who acts as our sub-processor for cardholder data and bank settlement.
  • Platform-not-party: The underlying contract for goods or services is between the buyer and the vendor. eventtally facilitates payment, transfer of funds, and dispute resolution as a marketplace intermediary; we are not the buyer of the vendor's services or the seller of the vendor's goods.

3. Use License

Permission is granted to temporarily access the materials on eventtally's website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

  • Modify or copy the materials;
  • Use the materials for any commercial purpose or public display (without our express consent);
  • Attempt to decompile or reverse engineer any software on our website;
  • Remove any copyright or proprietary notations from the materials; or
  • Transfer the materials to another person or "mirror" the materials on any other server.

User Content

When you submit inquiries or other content on our website, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display such content for the purpose of providing our services. You represent that you own or have the necessary rights to the content you submit.

Prohibited Uses

You may not use our website:

  • In any way that violates any applicable law or regulation
  • To transmit any harmful or malicious code
  • To impersonate or attempt to impersonate eventtally or any employee
  • To harass, abuse, or harm another person
  • To spam or send unsolicited communications

Intellectual Property

All content on eventtally, including venue listings, images, logos, and designs, is the property of eventtally, our venue partners, or licensed content creators and is protected by international copyright laws. Unauthorized use of our content may violate copyright, trademark, and other laws.

EventCenter Listings

EventCenter information is provided by venue owners and partners. While we strive for accuracy, eventtally does not guarantee the completeness, accuracy, or timeliness of venue listings. We recommend confirming all details directly with the venue before making any commitments.

Disclaimer

The materials on eventtally's website are provided on an "as is" basis. eventtally makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property.

8. Limitations of Liability

In no event shall eventtally, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service;
  • Any conduct or content of any third party on the Service;
  • Any content obtained from the Service; and
  • Unauthorized access, use, or alteration of your transmissions or content.

9. Indemnification

You agree to defend, indemnify, and hold harmless eventtally and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) Content posted on the Service.

10. Links to Other Websites

Our website may contain links to third-party websites that are not owned or controlled by eventtally. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites.

11. Modifications

eventtally may revise these Terms of Service at any time without notice. By using this website, you are agreeing to be bound by the current version of these Terms of Service.

12. Governing Law

These terms shall be governed by and construed in accordance with the laws of the United Kingdom (England and Wales), without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
